Welcome to BrightContext, a website (“Site”) and service (“Service”) owned and operated by BrightContext Corporation (“COMPANY,” “us,” or “we”). We know you are concerned about privacy, so we developed this privacy policy (“Privacy Policy”) to explain how we collect, use, and disclose information from you, our user (“you” or “your”). Read on and we will tell you how this all works.

YOUR PERSONAL INFORMATION MAY BE PROCESSED BY US IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.  BY USING THIS SITE AND PROVIDING ANY PERSONAL INFORMATION, YOU ARE CONSENTING TO THE TRANSFER OF DATA FROM YOUR COUNTRY TO A COUNTRY THAT HAS LESS STRINGENT LAWS, AND THE PROCESSING OF YOUR PERSONAL INFORMATION IN CONFORMANCE WITH THIS POLICY.

To be clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean your contact information (e.g., your name, address, email address, or telephone number) and any other non-public information that is associated with your contact information. When we use the phrase “Anonymous Information” in this Privacy Policy, we mean information that is not associated with or linked to your Personal Information. Anonymous Information does not enable identification of or contact with individual persons. “Application Data” means data that is transacted through our platform by applications via our applications programming interfaces (APIs) as well as data and information entered into our platform via the web-based management dashboard for the Service.

Information We Collect

Personal Information

In general, the Personal Information we gather enables us to provide the Services to you and helps us learn more about the use of the Site and/or Services.  We only collect Personal Information that you submit to us voluntarily. For example, if you communicate with us through our Site or by sending us an email, we may collect and store any information that is contained in your communications with us.

We may collect certain Personal Information in order to process your subscription, including a credit card number and associated billing information, and charge and collect the subscription fees. We refer to this information as “Billing information”. Notwithstanding anything to the contrary in this Privacy Policy, we will only use this Billing Information to process and collect fees.

Anonymous Information

As you use the Site or Services, certain Anonymous Information may be passively collected and stored, such as your Internet protocol address, domain names, browser type, and access times.  We may also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed. “Cookies” are small pieces of information that a website sends to your browser while you are viewing a website. Application Data

Use of the BrightContext’s service involves sending Application Data into and receiving data from the platform via our APIs. This Application Data may be saved within the platform and may be made accessible to Customers for their respective use. Whether this data is saved or not will be governed by the features offered by different Service levels.  Different Service levels may have different amounts of data retention associated with them. Customers may be required to pay for additional premium services in order to access features for viewing or managing their respective Application Data.  For example, accessing transaction history, certain metrics presentations, and export utilities may require subscription to premium levels of the Service.

How We Use the Information

Personal Information

We will use your Personal Information to:

  • Administer your Account;
  • Provide you with Services and customer support;
  • Tailor the features of the Site or Services to you;
  • Respond to your requests, resolve disputes and/or troubleshoot problems;
  • Verify your compliance with your obligations in our Terms of Use and/or other agreements you may have executed with us; and
  • Communicate with you about the Site and the Services.

We may also use your Personal Information to create Anonymous Information records by excluding information that makes the information personally identifiable to you.

We also use your Personal Information to contact you and provide you with information that may be useful or interesting to you, including newsletters regarding changes and upgrades to the Services as well as promotional e-mails. By using the Site, you agree to receive this information from us. If you do not want us to send you emails or otherwise contact you, you can always opt out of communications by following the instructions we provide to you when we contact you or by emailing us at support@brightcontext.com. We may, however, send certain administrative emails which pertain to the Site and Services on a regular basis that you may not opt-out of.

Anonymous Information

We may, through our use of Cookies and page tags, keep you logged into our Site or Services, collect your click-stream data, and personalize your experience on the Site or Services (including by tailoring content and functionality to you). We may use your Anonymous Information to analyze usage patterns so that we may enhance the Site or Services, improve the content of our software, and customize the Site or Services to you. We may also use your Anonymous Information to improve our Site, Service, operations, and do usage analysis for marketing purposes.

Application Data

We use Application Data to assist with development, optimization, and maintenance of our platform.  This process includes generating operational and traffic reports.  These reports are used by us to operate the platform as well as may be made accessible to Customers so they can review activity for their respective account. We may create reports and metrics that anonymously aggregate usage information across multiple customer accounts (“Aggregate Platform Data”) to support platform usage analysis.  We may use Application Data to notify you of new offers and services by BrightContext.

How We Disclose the Information

Personal Information

We may disclose certain Personal Information:

  • To third party vendors who help us provide the Services or the Site;
  • To third parties to whom you ask us to send Personal Information;
  • To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;
  • To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process your Personal Information as set forth in this Privacy Policy; or
  • If we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Use; (b) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (c) protect and defend our rights or property or the rights and property of you or third parties.

Application Data

We do not disclose Application Data to third parties.  We may disclose Aggregate Platform Data.  For example, we may advertise the total number of transactions that pass through the platform.

Interface with Social Networks

We may create interfaces that allow you to connect and interact with social networking websites such as Twitter and Facebook (each, a “Networking Site”) through our Service. We work with a Networking Site’s application programming interface in a way that allows you to authorize us to access your account on Networking Site on your behalf. We may do this through methods that may require you to log into the Networking Site via our Service. Once authorized by you, the Networking Site may provide us a security token that allows our platform to communicate with the Networking Site on your behalf. You can revoke our access to Networking Site at any time by amending the appropriate settings from within your account settings on Networking Site.

Third Party Cookies

We may use a third party tracking service to track and analyze Anonymous Information from Users of our Site. Such third parties may use Cookies to help track User behavior.

Forums and Comments

BrightContext may provide forums, blogs, or chat rooms on the Site and Service. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. BrightContext is not responsible for the personal information you choose to submit in these forums.

Correcting or Updating Information

You may correct and update information we collect from you by logging into the Service and accessing your account. If you change and/or request changes to your information, subsequent uses or disclosures of that information by us will reflect those changes, however, we do not have the ability to update any information previously disclosed to any third party. We will correct any inaccuracies in any Personal Information that we have in our possession once notified of the requested change.

Customer Testimonials

BrightContext may post a list of Customers and testimonials on the Company’s Web site that contain information such as Customer names, titles, and logos. Customer approves such listing or posting of testimonials.

Children

BrightContext is not intended for or directed to persons under the age of 13. Any person who provides their information to BrightContext represents to us that they are 13 years of age or older.

Security

We will take reasonable precautions to protect personally identifiable information in our possession from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet or method of electronic storage is, however, 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personally identifiable information, we cannot guarantee its absolute security.

The Site and Service may contain links to other sites that are not owned or controlled by us. Please be aware that BrightContext is not responsible for the privacy policies of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifiable information. This privacy policy applies only to information collected by this website.

Consent & Changes to this Policy

By using BrightContext, you agree to this Privacy Policy. This is our entire and exclusive Privacy Policy and it supersedes any earlier version. Our Terms of Service take precedence over any conflicting Privacy Policy provision. We may change this Privacy Policy by posting a new version of this Privacy Policy on this website which it is your responsibility to review.
